PARLIAMENTARY ELECTIONS (COMPOSITION OF OFFENCES) REGULATIONS
2006
In
exercise of the powers conferred by section 109 (2) of the Parliamentary
Elections Act, the Prime Minister hereby makes the following Regulations:Citation and commencement
1.
These
Regulations may be cited as the Parliamentary Elections (Composition of
Offences) Regulations 2006 and shall come into operation on 19th
April 2006.
Compoundable offences
2.
The
following offences may be compounded by the Returning Officer, or
any officer of the Elections Department who is authorised by the
Returning Officer, in accordance with section 109 (1) of the Act:(a)
any corrupt practice under section
61 (1) (c) (i) of the Act;
(b)
any corrupt practice under section
61 (1) (c) (ii) of the Act read with regulation
3 of the Parliamentary Elections (Election Advertising) Regulations (Rg 3);
(c)
any offence under section 71 (5),
78B (3), 78C (2), 78D (2), 85 (2) or 104 (2) of the Act;
(d)
any illegal practice under section
74 (4) read with section 79 of the Act for failing to transmit,
within the time limited by section 74 (1) of the Act, the returns
and statements respecting election expenses;
(da)
any illegal practice under section 74(4A) read with
section 79 of the Act for failing to transmit, within the time limited
by section 74(1A) of the Act, the consolidated return respecting
election expenses and statements;
(e)
any
offence under section 78A (2) of the Act read with regulation 4, 5, 6 or 7(2) of
the Parliamentary Elections (Election Advertising) Regulations (Rg 3),
as the case may be;
(f)
any offence under section 82(1)(d) or (e) read with section
82(2) of the Act; and
(g)
any
offence under regulation 19A(1) or 23(a),
(b) or (c) of the Parliamentary
Elections (Election Advertising) Regulations.
